PRINCIPAL LEGAL AND ENFORCEMENT OFFICER (Re- Advertisement)

Reports to: Deputy Director, Legal and Enforcement

MAIN PURPOSE OF THE JOB:

To provide end to end board secretariat services to NBFIRA Board Committees, as well as board secretarial support to the Board Secretary.

To provide high quality advice, opinion and assistance to NBFIRA on legal matters and issues, for formulating the best possible legal solution and for guiding NBFIRA in taking an appropriate decision

To carry out effective enforcement in respect of any non-compliance of NBFIs to applicable legislations and regulations

KEY PERFORMANCE AREAS:

  • Good, reliable, timely professional advice within the legal framework
  • Effective management of legal compliance issues
  • Maintaining up to date database and record of legal documents
  • Compliance with all relevant policies, procedures and regulations
  • Number of enforcement actions
  • NBFIs implementing remedial measures to address weaknesses and non-compliance
  • Strength of working relationship with internal and external stakeholders
  • Quality of reports (complete, accurate, timely)
  • Contribution and adherence to plan/ budget/ target
  • Meeting reporting obligations (including Board Secretarial)
  • Departmental risks minimised and mitigated

POSITION REQUIREMENTS:

  • At least a Degree in Law from a recognised institution and a license to practice law in Botswana
  • A master’s in Law, Economics, Business or related fields from a recognised institution will be an added advantage
  • At least 8 years of similar post-qualification experience, including a minimum of 2-3 years in a comparable line management position

KEY SKILLS AND COMPETENCIES:

  • Specialised knowledge and technical skills in the application of Laws and legislations in Botswana
  • Licensing, supervision, and enforcement activities
  • Procedures, processes, best practices in financial supervision and regulation
  • Acts governing the NBFIs
  • Proficient in the use of computers and software relevant to the position
  • Personal value system (personal integrity, conscientiousness & strong moral character)
  • Results and performance driven
