1. The above subject matters refer.
2. The Non-Bank Financial Institutions Regulatory Authority (“the Authority”) is empowered by Section 4(2)(d) of the Non-Bank Financial Institutions Regulatory Authority Act of 2016, to make rules, set standards and provide guidelines to the industries it regulates. Such rules include the Fit and Proper Rules for Controllers as updated in 2022.
3. Section 4.2.6 of the Fit and Proper Rules requires that applicants for vetting shall provide a completed personal questionnaire, among other documents.
4. It has been the practice that controllers were also required to submit a completed biographical affidavit form that required the same information sought by the personal questionnaire.
5. To reduce the duplication, the Authority has modified the personal questionnaire by combining the required information in one form. The biographical affidavit form will no longer be required.
6. Attached is the revised personal questionnaire form to be completed by applicants for vetting as controllers. The form has been uploaded onto the NBFIRA website.
7. The changes take effect immediately.
