GUIDANCE NOTE ON LICENSING AND RECOGNITION OF COLLECTIVE INVESTMENT UNDERTAKINGS UNDER THE REVISED COLLECTIVE INVESTMENT UNDERTAKINGS ACT, 2021

1. The Collective Investment Undertakings Act, 2021 (“the CIU Act”), commenced on 28th February 2022, all aspirant operators of collective investment undertakings (CIUs) listed in the CIU Act are reminded to apply for licences or recognition as required by Section 19(1) of the CIU Act and Part VI of the Collective Investment Undertakings Regulations (CAP. 56:09) (the CIU Regulations).
 
2. The public is advised that the CIU Regulations are currently being finalised and the date of coming into effect of the revised Regulations will be communicated in due course. Therefore, the current Regulations continue to be in force until new ones are ready for use, as empowered by Section 96(4) of the CIU Act.
 
All applications for licensing should be submitted through the NBFIRA Risk Based Supervision Portal. The CIU Act and the CIU Regulations are available on the NBFIRA website (www.nbfira.org.bw).
