Commencement Of The Securities (Amendment) Act, 2023

Members of the public are informed that the Securities (Amendment) Act of 2023 (the Act) commenced on January 15, 2024.

The commencement follows the Act’s amendment by the Parliament of Botswana on November 13, 2023. The important section to note, amongst others is the revised definitions of an “Asset Manager”, “Investment Advisor” and “Securities service”. Companies or individuals undertaking any of the added activities as per the new definitions, are required to apply for licensing with NBFIRA. The Securities Act, 2023, is accessible on the NBFIRA website at: www.nbfira.org.bw.  

Members of the public affected by the changes should ensure full compliance with the Act at all times.
