SUBJECT: Personal Questionnaire For Controllers/Key Persons
1. The above subject matters refer.
2. The Non-Bank Financial Institutions Regulatory Authority (“NBFIRA”) is empowered by Section 5(2)(e) of the Non-Bank Financial Institutions Regulatory Authority Act of 2023, to give directions to any person to ensure compliance with the relevant law, rule, standard or guideline.
3. Pursuant to this mandate, the Regulatory Authority hereby directs all non-bank financial institutions to immediately adopt and implement the revised Personal Questionnaire for Controllers, which now includes a Data Privacy Notice in alignment with the Data Protection Act, 2024.
4. The updated questionnaire is attached to this circular and has also been uploaded to the NBFIRA website. All applicants undergoing vetting as controllers must complete this revised questionnaire without exception.
5. These changes take effect immediately. All institutions are required to ensure full compliance with this directive.
