The Non-Bank Financial Institutions Regulatory Authority Act 2006 established the Non-bank Financial Institutions Regulatory Authority (NBFIRA), to regulate and enforce compliance within the Non-Bank Financial Institutions sector in order to safeguard the stability, fairness and efficiency of the non-bank financial sector.

The Authority is in search of qualified individuals to fill the below positions:

DIRECTOR – COMPLIANCE

Main purpose of the job

To oversee the enforcement of industry/sector compliance with the applicable legislation, rules and regulations and provide legal advice in order to protect investors and the integrity of the Authority. The role will also provide efficient Board Secretarial services.

Key Performances

·         Review and recommend amendments to legislation applicable to supervised institutions to ensure they align with international standards and best practice;

·         Oversee activities of regulated institutions to ensure statutory and legal compliance by industry players;

·         Approve draft contracts and documents relating to the Authority, briefs counsel, attorneys and advisers on the preparation of documentation;

·         Formulate and implement budgets for the division in line with the approved Strategy;

·         Guide the development and implementation of effective risk based supervision and monitoring plans for regulated entities to ensure strict compliance with the governing laws, rules and regulations;

·         Review surveillance manuals, procedures, business and market conduct rules for supervised institutions in consultation with Management

·         Chair hearings on disputes referred to NBFIRA for arbitration and settlement;

·         Review enforcement of sanctions for non-compliance and recommend legal action for breaches of regulatory and legislative requirements and liaises with relevant committees and government officials on prosecution in terms of the applicable Act;

·         Carry out investigations in consultation with regulatory departments.

·         Advises the Board in all legal, regulatory and corporate governance developments affecting the Authority.

·         Carry out legal instructions of the Board and ensure implementation of Board resolutions

·         Provide efficient Board Secretarial services and administrative support, and general corporate secretarial duties to NBFIRA.

 

Experiences & Qualifications

·         Master’s Degree in Business Administration or Law or related field

·         Membership to a professional internationally recognized institute will be an added advantage

·         At least twelve (12) years’ experience, two (2) of which should have been at senior management level

·         Professional experience within a regulatory environment employing risk-based supervision practices will be considered a definite plus.

DIRECTOR – LENDING ACTIVITIES

Main Purpose of the job

To lead in the development and review of the regulatory framework for Lending Activities and ensure that all regulated activities in the sector are conducted in strict compliance to the governing laws as per the NBFIRA act

Key performance Areas

·         Leads in the development and review of the regulatory framework for Lending Activities in order to create an efficient, orderly and fair market;

·         Leads in the development and review of consumer protection and public awareness policies in order to ensure consumer and public confidence in the markets;

·         Ensures that supervision plans are developed and implemented in order to protect consumer and public interests;

·         Reviews fee and levy structures and makes recommendations to the Board and the Line Ministry;

·         Develops and manages the divisional budget in order to ensure optimal resource utilisation;

·         Ensures that new products/services are thoroughly screened prior to granting or recommending approval in order to ensure market stability;

·         Reviews licensing applications and recommends approval to the Chief Executive and/or the Board;

Experiences & Qualifications

  • Master’s Degree in Economics, Finance, Accounting, Business Management or related field
  • Membership of a professional and internationally recognized credit/banking/accounting/financial institute will be an added advantage

·         Minimum of 12 years’ experience in a financial services/regulation environment of which at least three (3) should have been at a minimum of Deputy Director level

  • Expert knowledge and understanding of monitoring techniques, principles, practices, processes and procedures.
  • Ability to identify network opportunities, encourage collaboration and establish relationships
  • Strong communication and reasoning ability, integrity and high ethical standards.
